B. Program Specific Categorical Exclusions Actions consistent with any of the following categories are, in the absence of extraordinary circumstances, categorically excluded from further analysis and documentation in an EA or EIS. A categorical exclusion determination may only be made after NEH has, if necessary, performed a review under Section 106 of the National Historic Preservation Act (“NHPA”) and determined and documented that such action is not reasonably likely to have an adverse effect on historic properties.

2. Construction, purchase or lease of new infrastructure, including, but not limited to, museums, libraries and other community buildings, and office space, that is similar to existing land use if the area to be disturbed has no more than two acres of new surface disturbance. The following conditions must be met: a. The structure and proposed use are compatible with applicable Federal, tribal, state, and local planning and zoning standards. b. The site and scale of the construction or improvement is consistent with those of existing, adjacent, or nearby buildings. c. The proposed use will not substantially increase the number of motor vehicles at the facility or in the area. d. The construction or improvement will not result in uses that exceed existing support infrastructure capacities (road, sewer, water, parking, etc.).
